the Internet. In support of this, we only use the personal information that you
provide to create a more personalized and entertaining experience for you, in accordance
with the terms outlined below.
FOR OUR CANADIAN CUSTOMERS
GUESS.ca uses the services of Borderfree, a registered partnership between Canada
Post and Borderfree Ltd, to allow you to see your total landed price including all
duties, taxes, shipping and handling charges in Canadian dollars before you place
your order. Here is some additional information for our valued Canadian buyers.
SHOPPING FULFILLMENT SERVICE
The purchase of any product from GUESS.ca while using the Borderfree Shopping Fulfillment
Service offered by Borderfree shall be a transaction solely between you and GUESS.ca.
Any question, request for support or dispute you may have regarding any product
should be addressed directly to GUESS.ca. Borderfree, its parent, subsidiaries or
affiliates or any of its or their respective employees, agents, officers, directors
or third party service providers has no responsibility or liability for your relationship
or dealings with GUESS.ca, or any products you acquire from GUESS.ca including their
quality and performance, including, without limitation, any failure in delivery
of said Goods to the Borderfree Distribution Center in the U.S., which shall be
the sole responsibility of GUESS.ca.
TITLE OF PRODUCTS At no
time does Borderfree take title to or responsibility for any products that it may
acquire, ship or accept on your behalf. Title in or to any products shall at all
times remain with, as applicable, GUESS.ca or you. The passing of title from GUESS.ca
to you shall be determined in accordance with GUESS.ca's standard terms and conditions
but notwithstanding the foregoing, in no instance will Title pass from GUESS.ca
to you at a time later than that of the receipt of said Goods at the Borderfree
Distribution Center in the U.S.
CUSTOMS BROKER By ordering
goods from GUESS.ca, you hereby authorize a licensed Canadian customs broker chosen
by Borderfree to act as your agent, and to transact business with Canada Customs
Revenue Agency (CCRA) to clear your merchandise, account for applicable duties and
taxes, to return merchandise to GUESS.ca and prepare and submit refund claims on
your behalf for any merchandise that you return. You understand that CCRA will send
any refund of duties and taxes that were paid on the returned merchandise to the
broker, and that you will obtain the refund directly from Borderfree. In this connection,
you also authorize the customs broker to endorse any refund check issued by CCRA
in your name, so that Borderfree can be reimbursed.
RESTRICTED PRODUCTS GUESS.ca
and Borderfree shall each have the right, in their sole discretion, to refuse to
provide service with respect to any product or quantity of products. This right
shall exist at all times, even after GUESS.ca or Borderfree have accepted your purchase
instructions.
INFORMATION COLLECTION
The purchase process requires you to give us your billing and shipping addresses
and credit card information. This information is also provided to Borderfree to
allow them to process and fulfill purchase instructions and to contact you with
status updates and service-related information.
At GUESS.ca, we may also use your contact information to e-mail you newsletters
that inform you of new products and special features at Guess.ca. We may also offer
you special promotions from our site or our sponsors. If you prefer not to receive
such communications, you may contact us using our
web contact form.
GUESS.ca also derives user information through some simple technical methods. We
may use data-tracking software that lets us know what areas of the site you visit
most often. This helps us present you with the information and features in which
you are most interested.
We may use your IP (Internet protocol) address to help diagnose problems with our
server, and to administer our Web site. Your IP address is used to help identify
you and your shopping cart and to gather broad demographic information.
Our site uses cookies to keep track of your shopping cart. We use cookies to deliver
content specific to your interests and to save your password so you don't have to
re-enter it each time you visit our site.
ORDER VERIFICATION In order
to protect you, us and Borderfree from fraudulent transactions, Borderfree may provide
your transaction-related information to a reputable third party organization to
perform address and credit verification. This address verification is intended to
ensure that the "bill to" address that you provide matches your credit card address.
Borderfree also reserves the right not to ship items ordered or purchased on this
website to certain addresses, at its discretion. In the event that Borderfree chooses
not to ship an item, you will be notified by GUESS.ca and your order will be automatically
cancelled.
FRAUD PREVENTION GUESS.ca
and Borderfree reserves the right to co-operate with local, provincial and national
authorities in investigations of improper or unlawful activities and this may require
the disclosure of personal information. We may also report to other organizations
about improper or unlawful user activities on Borderfree and this reporting may
include disclosure of personal information relating to those individuals conducting
such improper or unlawful activities.
WARRANTY COVERAGE AND LIABILITY
Borderfree is not liable or responsible for the character, quality, performance,
quantity, size, color, merchantable quality, or fitness for a particular purpose
of any product acquired by you or on your behalf from GUESS.ca or any act or omission
of GUESS.ca. The warranty coverage for a product, if any, shall be limited to the
coverage offered by GUESS.ca or manufacturer of the product. You acknowledge that
some warranty programs are valid only in the jurisdiction where the Web merchant
resides and that it is your sole responsibility to determine if the warranty program
for any product you purchase will be honored where you reside. You acknowledge and
agree that Borderfree shall not in any case be liable for any amounts which exceed
the value of the particular item being purchased or for any indirect, consequential,
special, incidental or punitive damages whether or not such Borderfree has been
advised of the possibility of such damages.
RETURNS All returns will
be subject to GUESS.ca and Borderfree's return policies. Subject to its then current
return policies, Borderfree will facilitate the return to GUESS.ca. Borderfree does
not guarantee that any product will be cleared through customs or that GUESS.ca
or applicable government authorities will issue any refund. Any credit issued, including
for gift returns, will be issued to the credit card used in the original purchase
and will include the original cost of the product plus any duties and taxes originally
charged, less any return charges imposed by GUESS.ca or Borderfree and any applicable
taxes. Borderfree also reserves the right to recover any actual logistics costs
incurred in the processing of a return back to GUESS.ca's returns facility in the
form of a reduced credit, unless otherwise instructed by GUESS.ca.
TAXES Borderfree is required
to charge to all Canadian customers GST/HST as applicable depending upon the Province
to where the shipment is made. GST/HST as it applies to the product and duty values
is a reimbursement to Borderfree for the GST/HST paid by Borderfree on your behalf
when the goods clear customs. Borderfree will also charge you GST/HST on the Borderfree
Shipping and Handling and/or Return Handling Fees. Any shipments made to Ontario
addresses will be assessed the Ontario Resale Sales Tax ("PST") by customs upon
crossing the border; Borderfree pays this on your behalf and includes the amount
to be reimbursed by you to us in your quote.
SECURITYProviding a safe
and secure environment for your order information is our top priority. GUESS? protects
the security of your online transaction by taking advantage of Secure Sockets Layer
(SSL) technology. The Canadian GUESS? Online Store uses digital certificates provided
by Equifax which are required for SSL, the industry standard for encryption. SSL
technology encrypts data allowing only GUESS? to decode your information and helps
to create a secure environment for transactions on the internet. To further protect
your security, we suggest you sign off of your account and close your browser window
after you have finished your visit, especially if you are using a computer shared
by others.
